The Buyer voluntarily enters into and agrees to all terms stated in this contract, as witnessed by their signature below.

The Seller guarantees that this dog is believed to be healthy at the time of sale and has received appropriate vaccinations and worming for its age. The Buyer has seven (7) days from the time of receipt to have the dog examined by a veterinarian, and proof of that examination must be provided to the Seller. This guarantee will terminate immediately if the dog is not examined within the allotted time.
 

If this dog is found to have a hereditary defect that clinically impacts its quality of life (excluding dental work) by four years of age, as certified by a qualified veterinarian at the Buyer's expense, the Seller has the right to require a second opinion from a veterinarian of the Seller's choosing at the Seller's expense.
 

A warranty for hip dysplasia is provided for five years after the date of sale. This warranty will terminate should the dog be allowed to become overweight or should its developing joints become overstressed at any point during the warranty period. Should the dog be found to have hip dysplasia within the first five years, the Buyer must provide the Seller with proof in the form of documentation from OFA or PennHIP.
 

This warranty does not include viral illnesses, infections, improper bites, umbilical hernias, hypoglycemia, Giardia, or Coccidiosis.


Rocky Mountain Bernedoodles' health warranty will terminate if an oral flea and tick medication is administered (for example, NexGard, Bravecto, Capstar, or Comfortis). These are toxic to the dog's nervous system and can cause seizures and life-threatening symptoms. _____ Initials


This warranty does not include orthopedic injuries (ACL tears, etc.). It also does not include any illness due to the ingestion of foreign objects, food, or chemicals, or due to physical injury. If the dog is euthanized or in any way disposed of without a second opinion from the Seller's preferred veterinarian, the Buyer waives all rights to a replacement puppy or to any financial compensation.

 

Buyer's Responsibilities

  1. The Buyer agrees that their puppy will be housed indoors.

  2. The Buyer agrees to feed their puppy only a premium-quality food.

  3. The Buyer agrees to keep their puppy at a healthy weight.

  4. The Buyer agrees to make and keep annual veterinary appointments for their puppy and to keep all immunizations current.

  5. The Buyer is encouraged to provide basic obedience training with their puppy within the first year of ownership.

  6. The Buyer agrees to postpone strenuous, repetitive exercise until after their puppy has reached one year of age.

Identification: The ISO microchip is scanned and recorded on the health agreement.

Length of Health Guarantee:

Rocky Mountain Bernedoodles offers a 5-year health guarantee.
 

This guarantee does not cover mistreatment, injury, accidents, or poisoning. It applies only if the dog is not overweight or underweight and has not been used in agility, running, or jumping, or over-exercised during its growth period of the guarantee. It does not cover trauma-related or environmental factors that have adversely affected the dog. Rocky Mountain Bernedoodles does not guarantee the dog's hips against any form of dysplasia attributable to non-genetic causes. This guarantee applies only to the original purchaser of this dog.
 

The Buyer must supply the Seller with a veterinarian's report indicating possible hereditary defects within seven days of making the first complaint to the Seller. The Buyer's nominated veterinarian must, if requested, forward a copy of all available reports to the Seller for review. The Seller will review the reports and advise whether a second opinion is required. If it is, the Seller will nominate a second veterinarian to whom the dog should be taken for further examination. The Seller will make all results from the second opinion available to the Buyer, at which point the following options may be available if the dog is certified, to the Seller's satisfaction, to have a hereditary defect clinically impacting its quality of life:

  1. The Seller will replace the dog with a puppy or dog of equal or greater value upon the Buyer meeting the above requirements. It is understood that a replacement dog may not be available at the time of the requested replacement; the Seller is given twelve months to act upon this guarantee.
     

  2. The Seller will reimburse the Buyer up to (and not exceeding) half of the purchase price of the dog, not including shipping costs. Reimbursement is defined as the Seller returning to the Buyer up to (and not exceeding) half of the original sale price of the dog, not including shipping.
     

  3. The Seller will choose one option or the other, not both.


Shipping: Buyer bears all costs.


Rehoming: If at any time the Buyer wishes to give away the dog, the Buyer will give the Seller every opportunity to help rehome it. The dog must not be destroyed or relinquished to a pound or shelter.


Definition: The warranty set forth in this contract is the sole warranty and is given in lieu of any and all other warranties, expressed or implied. The Buyer's sole remedy is under the warranty provision of this contract. The Seller disclaims and will not be liable for any other damages, including consequential damages, property damage, emotional distress, loss of use, business interruption, or veterinary fees, unless specifically set forth in this warranty provision. This contract sets forth the entire agreement between the Seller and Buyer, and any inconsistent oral terms have no effect on this contract. If there is any dispute or litigation between the Seller and Buyer, the prevailing party will be entitled to reasonable attorney's fees and costs.
 

I, the Buyer of the dog described in this document, hereby declare that I have read, fully understand, and agree with the terms of this contract.
 

The Buyer acknowledges that their puppy has not received its rabies vaccination unless it is a turnkey puppy. _____ Initials

 

Spay and Neuter:
 

Permanent ownership of this dog is contingent upon your compliance with this addendum. Rocky Mountain Bernedoodles must receive proof of the spay/neuter within 12 months after you receive your puppy. If the surgery is not done within that time, Rocky Mountain Bernedoodles must be provided with a statement from your veterinarian confirming that the dog is not yet in physical or emotional condition for surgery. Based on the veterinarian's evaluation, the Purchaser will contact the veterinarian to determine the earliest date the procedure can be performed and will notify the Breeder of this amendment in writing, at which time all other conditions of this agreement will apply and be enforced. It is the responsibility of the Purchaser, not the veterinarian, to ensure that Rocky Mountain Bernedoodles has received verification that the surgery has been performed. Failure to comply with this agreement by the date below, unless otherwise agreed to in writing, will be considered a breach of contract, and the Purchaser may be liable for up to $25,000.00. Failure to comply with this agreement will void the Health Guarantee.

 

By my signature below, I agree to have this dog spayed or neutered no later than one year after its whelping date/date of birth, and I understand that this spay/neuter agreement means this dog will not produce a litter of puppies, either through intentional or accidental breeding. If a pregnancy occurs, whether intentional or accidental, I agree to pay the additional cost for a breeding dog, which is $25,000.00. I also agree that failure to comply with this agreement will void the Health Guarantee.

This contract is transferable in a rehoming situation only if the new owner(s) are willing to sign and abide by a new contract with Rocky Mountain Bernedoodles, and only if Rocky Mountain Bernedoodles approves the transfer.
